Sale of paintings

The works shown on this website are a non-binding presentation of the artist's work, not goods in an e-shop. Displaying a work together with a price here is not an offer to conclude a contract. By way of derogation from the presumption in Section 1732(2) of the Civil Code (Act No. 89/2012 Coll., the "Civil Code"), it is an invitation to get in touch if you are interested. A contract of sale arises only by individual agreement, once I confirm the specific terms.

You conclude the contract for the purchase of a work with kreativum s.r.o., Company ID 25297805, registered office U Krematoria 2622, 530 02 Pardubice. Veronika Tucoglidisová sells her works through this company.

How a purchase works

If you are interested in a work, write to me by e-mail. We agree on the work, the price and the way it will be handed over. The price shown with a work is final. If you do not collect the work in person, the cost of delivery is added to it. You pay the price of the work and the delivery in advance to the account stated in the payment request, which I send to your e-mail address. The variable symbol stated in the request identifies the payment. Before the contract is concluded I provide you with the information under Sections 1811 and 1820 of the Civil Code.

Right of withdrawal

If, as a consumer, you conclude the contract at a distance (for example by e-mail) or away from premises usual for business, you have the right under Section 1829(1) of the Civil Code to withdraw from the contract within 14 days. For the purchase of a work this period runs from the day you take delivery of it. You do not have to give a reason and no penalty may be attached to the withdrawal (Section 1818 of the Civil Code). The period is met if you send the notice of withdrawal within it.

If I fail to inform you of the right to withdraw, the period is extended by up to one year (Section 1829(4) of the Civil Code).

You, as the buyer, bear the cost of returning the work (Section 1820(1)(j) and Section 1832(3) of the Civil Code). I recommend insuring the parcel. I will refund the purchase price, including the delivery cost corresponding to the cheapest delivery method offered, at the latest within 14 days of withdrawal (Section 1832 of the Civil Code). I need not refund the money before I receive the work back or before you prove that you have sent it.

The right of withdrawal does not arise for a work made to your requirements or adapted to your personal needs, that is, a commissioned painting (Section 1837(d) of the Civil Code). The statutory 14-day withdrawal applies to contracts concluded at a distance or away from business premises. It does not apply to a purchase concluded on the seller's business premises.

Handmade works, complaints

The works on offer are original handwork. Their individual character, that is, minor irregularities, texture or tool marks, is a property of the work and not a defect, provided the work corresponds to how it was presented. The same applies to fine-art prints on handmade paper. A complaint will be settled within 30 days of being made at the latest (Section 19(3) of Act No. 634/1992 Coll., on Consumer Protection).

Copyright

By buying a work you acquire ownership of the physical object, not the right to use the work, that is, to reproduce it or make reproductions of it in any form. Copyright remains with the author (Section 9(3) of the Copyright Act, No. 121/2000 Coll.).

Seller and out-of-court dispute resolution

The Czech Trade Inspection Authority is competent for the out-of-court resolution of consumer disputes arising from the contract of sale (Sections 14 and 20e(d) of Act No. 634/1992 Coll., on Consumer Protection). Further information is available at www.coi.cz.
